01 Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (whether as a shipper, carrier, driver, broker, or any party engaging with Singh Trucklines services) and Singh Trucklines (“Company,” “we,” “our,” or “us”).

By accessing our website at www.singhtrucklines.com, submitting a load request, entering into a rate confirmation, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

IMPORTANT: If you do not agree to these Terms, do not use our services. Continued use constitutes acceptance of any updates to these Terms.
 

02 Services

Singh Trucklines provides freight transportation, logistics coordination, and related trucking services across the United States. Our services include but are not limited to:

  • Full Truckload (FTL) and Less-than-Truckload (LTL) freight transportation
  • Freight brokerage and carrier sourcing
  • Dry van, flatbed, and refrigerated (reefer) transport
  • Intermodal logistics coordination
  • Dispatch and load management services
  • Real-time freight tracking and status updates

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected parties.

 

03 Carrier Obligations

Carriers operating on behalf of or in coordination with Singh Trucklines agree to the following obligations:

  • Maintain valid FMCSA operating authority (MC number) and DOT number in active, satisfactory status
  • Carry and maintain all required insurance coverage as specified in our carrier packet
  • Comply with all applicable federal and state transportation regulations, including Hours of Service (HOS) rules
  • Use only qualified, licensed CDL drivers for all loads assigned by Singh Trucklines
  • Provide accurate and timely load status updates including pickup, in-transit, and delivery confirmations
  • Not re-broker, double-broker, or sub-contract any load without express written consent
  • Return all signed Proof of Delivery (POD) documents within 24 hours of delivery
  • Immediately notify Singh Trucklines of any accidents, cargo claims, or service failures
  • Comply with shipper-specific requirements disclosed at the time of load tender
Double brokering or unauthorized sub-contracting of loads is a serious violation that may result in immediate termination of carrier status, forfeiture of payment, and potential legal action.
 

04 Shipper Obligations

Shippers utilizing Singh Trucklines services agree to:

  • Provide accurate shipment information including weight, dimensions, commodity type, and hazmat classification if applicable
  • Ensure cargo is properly packaged, labeled, and prepared for transport
  • Provide access to loading and unloading facilities at agreed-upon appointment times
  • Disclose any special handling, temperature control, or equipment requirements in advance
  • Not tender freight that exceeds legal weight limits or dimensional restrictions without prior authorization
  • Pay all agreed-upon freight charges, accessorial fees, and applicable tariffs on time
  • Provide complete and accurate shipping documentation including Bills of Lading

 

05 Rates & Payment

All freight rates are agreed upon in writing via Rate Confirmation or Load Tender prior to dispatch. The following payment terms apply:

  • Payment terms are net 30 days from receipt of invoice and completed delivery documentation, unless otherwise agreed in writing
  • Invoices must include the signed Proof of Delivery (POD), Bill of Lading, and any required supporting documents
  • Accessorial charges (detention, layover, TONU, lumper fees, etc.) must be pre-authorized and documented to be payable
  • Disputed invoices must be raised in writing within 10 business days of invoice date
  • Late payments may be subject to interest charges of 1.5% per month on outstanding balances
  • Quick Pay options may be available at a fee; contact us for details
Fuel Surcharge: Applicable fuel surcharges are updated weekly based on the DOE national average and will be included in the agreed rate confirmation.
 

06 Liability & Cargo Claims

Liability for freight loss, damage, or delay is governed by the Carmack Amendment (49 U.S.C. § 14706) and any applicable provisions agreed upon in the Rate Confirmation.

  • Cargo claims must be filed in writing within 9 months of the date of delivery or reasonable expected delivery
  • Any civil action for cargo loss or damage must be initiated within 2 years from the date of denial of the claim in writing
  • Claims must be submitted with supporting documentation including the Bill of Lading, delivery receipt, photos of damage, and repair/replacement invoices
  • Singh Trucklines will not be liable for losses resulting from shipper error, improper packaging, inherent vice of the goods, or acts of God
  • Maximum carrier liability is limited to the amount set forth in the applicable tariff or rate confirmation, not to exceed actual loss

 

07 Insurance Requirements

All carriers authorized under Singh Trucklines must maintain the following minimum insurance coverage:

  • Auto Liability: $1,000,000 per occurrence (minimum)
  • Cargo Insurance: $100,000 per occurrence (minimum), or as required by specific shipper
  • General Liability: $1,000,000 per occurrence
  • Workers’ Compensation: As required by applicable state law

Singh Trucklines must be listed as an additional insured and certificate holder. Certificates of Insurance must be provided prior to dispatch and kept current at all times.

 

08 Prohibited Cargo

The following cargo types are prohibited from transport under these Terms unless separately authorized in writing:

  • Illegal substances or contraband of any kind
  • Hazardous materials (HAZMAT) without prior DOT/PHMSA compliance and carrier authorization
  • Stolen, counterfeit, or unauthorized goods
  • Explosives, firearms, or ammunition without appropriate permits and authorization
  • Live animals without prior arrangement and appropriate equipment
  • Perishable goods in equipment not rated or certified for temperature control
  • Any goods prohibited by U.S. federal or state law
Violation Notice: Tendering prohibited cargo without disclosure may result in immediate termination of the relationship, forfeiture of payment, and referral to appropriate law enforcement authorities.

 

09 DOT & Regulatory Compliance

All parties agree to comply fully with applicable regulations including:

  • Federal Motor Carrier Safety Administration (FMCSA) regulations (49 CFR)
  • U.S. Department of Transportation (DOT) requirements
  • Hours of Service (HOS) regulations for commercial motor vehicle drivers
  • Electronic Logging Device (ELD) mandate requirements
  • Drug and alcohol testing programs per 49 CFR Part 382
  • State weight and dimension laws applicable to each jurisdiction traveled
  • All applicable environmental regulations

 

10 Indemnification

Each party agrees to indemnify, defend, and hold harmless the other party, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Breach of these Terms or any applicable law or regulation
  • Negligence, willful misconduct, or fraudulent acts by the indemnifying party
  • Bodily injury, property damage, or cargo loss caused by the indemnifying party
  • Violation of any third-party rights or intellectual property

 

11 Dispute Resolution

In the event of any dispute arising from or relating to these Terms or any services provided by Singh Trucklines, the parties agree to the following process:

  • Step 1 – Good Faith Negotiation: The parties will attempt to resolve any dispute within 30 days through direct, good-faith communication
  • Step 2 – Mediation: If unresolved, the parties agree to non-binding mediation before a mutually agreed-upon mediator
  • Step 3 – Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA)

Class action lawsuits and jury trials are expressly waived to the extent permitted by law. Each party bears its own arbitration costs unless the arbitrator determines otherwise.

 

12 Termination

Singh Trucklines reserves the right to terminate or suspend services with any carrier, shipper, or party under the following circumstances:

  • Material breach of these Terms not cured within 5 business days of written notice
  • Loss or suspension of operating authority, insurance, or required licenses
  • Fraudulent, deceptive, or criminal conduct
  • Repeated failure to meet service standards or delivery commitments
  • Double brokering or unauthorized sub-contracting
  • Insolvency, bankruptcy filing, or cessation of business operations

Upon termination, all outstanding obligations (including payment for completed services) remain in full force and effect.

 

13 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and applicable state law. Federal transportation law, including the Carmack Amendment and applicable FMCSA regulations, shall take precedence over conflicting state law provisions.

Any legal proceedings not subject to arbitration shall be brought exclusively in a court of competent jurisdiction within the United States.

Entire Agreement: These Terms, together with any signed Rate Confirmation or Carrier Agreement, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements relating to the subject matter herein.
